NOTICE OF PRIVACY PRACTICES

This Notice of Privacy Practices (“Notice”) describes how Sierra Behavioral Therapy (“we,” “us,” or “our”) may use and disclose your protected health information (“PHI”) in connection with Applied Behavior Analysis (ABA) and related behavioral health services, and how you can access this information.
Please review this Notice carefully.
OUR LEGAL OBLIGATIONS
We are required by law to:
- Maintain the privacy and security of your PHI
- Provide you with this Notice explaining our legal duties and privacy practices
- Follow the terms of this Notice currently in effect
- Notify you if a breach occurs that compromises the privacy or security of your PHI
HOW WE USE AND DISCLOSE YOUR PHI
1. Treatment
We may use and disclose PHI to provide, coordinate, or manage ABA and behavioral health services. This includes, but is not limited to:
- Developing and implementing treatment plans
- Conducting assessments, skill acquisition programs, and behavior intervention plans
- Supervising Registered Behavior Technicians (RBTs)
- Communicating with caregivers, legal guardians, and authorized representatives
- Coordinating care with physicians, schools, therapists, and other service providers involved in treatment
2. Payment
We may use and disclose PHI for billing and payment purposes, including:
- Insurance eligibility verification
- Claims submission and processing
- Utilization review and authorization requests
- Coordination of benefits
3. Healthcare Operations
We may use and disclose PHI for healthcare operations necessary to operate our practice, including:
- Quality assurance and improvement activities
- Clinical supervision and staff training
- Licensing, accreditation, and compliance reviews
- Administrative, legal, and business operations
4. Caregiver and Guardian Access
For minor clients or individuals with legal guardians, we may disclose PHI to parents, guardians, or authorized caregivers consistent with applicable law and consent documentation on file.
5. Required by Law
We may disclose PHI when required by federal, state, or local law, including:
- Mandatory reporting obligations
- Court orders or lawful subpoenas
6. Public Health and Safety
We may disclose PHI to appropriate authorities to:
- Prevent or reduce a serious threat to health or safety
- Report suspected abuse, neglect, or exploitation
- Comply with workers’ compensation or similar laws
7. Business Associates
We may share PHI with third parties (“Business Associates”) who perform services on our behalf, such as:
- Billing and practice management systems
- Electronic health record platforms
- Secure scheduling, communication, or documentation tools
Business Associates are contractually required to safeguard PHI and comply with HIPAA.
8. Uses and Disclosures with Authorization
Any use or disclosure of PHI not described in this Notice will be made only with your written authorization. You may revoke your authorization in writing at any time, except where we have already relied on it.
YOUR RIGHTS REGARDING YOUR PHI
You have the right to:
- Access and obtain copies of your health records, subject to limited exceptions
- Request amendments to your PHI if you believe it is inaccurate or incomplete
- Request restrictions on certain uses or disclosures (we are not required to agree to all requests)
- Request confidential communications, such as contacting you by a specific method or location
- Receive an accounting of disclosures of your PHI, as permitted by law
- Receive a paper copy of this Notice upon request
Requests must be submitted in writing.
WEBSITE & NON-PHI INFORMATION
This Notice applies only to Protected Health Information created or received in the course of providing ABA and behavioral health services.
Information collected through our website (such as cookies, analytics data, or general contact inquiries) is governed by our Privacy Policy and Cookie Policy and is not considered PHI unless submitted as part of treatment, intake, or care coordination.
COMPLAINTS
If you believe your privacy rights have been violated, you may file a complaint with:
Sierra Behavioral Therapy
or
U.S. Department of Health and Human Services
Office for Civil Rights
You will not be retaliated against for filing a complaint.
CHANGES TO THIS NOTICE
We reserve the right to change this Notice at any time. Changes will apply to all PHI we maintain. The most current version will be available on our website and upon request.
